RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

ON ACCELERATION OF MEASURES TO REFORM THE HYDROPOWER SECTOR
In order to ensure a stable supply of energy resources to the population and sectors of the economy, reduce the consumption of natural gas in the production of electricity, and effectively use the potential of the hydropower sector:
1. Agree with the proposals of the Ministry of Energy, the Ministry of Investment, Industry and Trade and JSC Uzbekgidroenergo (hereinafter referred to as the Company) to increase the total capacity of hydroelectric power plants to 5,508 MW by the end of 2028, including the construction of pumped-storage power plants with a total capacity of 1,600 MW.
2. Approve the Program of Measures for the Further Development of the Hydropower Sector for 2024-2028 (hereinafter referred to as the Program), which provides for:
The list of investment projects implemented by JSC Uzbekgidroenergo for the construction of hydroelectric power plants with a total capacity of 1,018 MW in accordance with Appendix No. 1*; "Roadmap" for the implementation of projects for the construction of hydroelectric power plants with a total capacity of 449 MW using foreign loans guaranteed by the Republic of Uzbekistan in 2024 in accordance with Appendix No. 1a*;
List of investment projects with a total capacity of 2275 MW, implemented with the participation of private investors in the hydropower sector, in accordance with Appendix No. 2*.
3. To establish the Republican Commission for the Development of the Hydropower Sector (hereinafter referred to as the Republican Commission) composed in accordance with Appendix No. 3*.
The Republican Commission (A. Aripov) shall ensure:
timely development of funds attracted from international financial institutions and other organizations, as well as attraction of direct investment for the implementation of investment projects defined by the Program;

timely development of pre-project documentation, as well as commissioning of investment projects provided for by the Program, within the established timeframes;

localization of production of equipment and spare parts required for the construction and operation of hydroelectric power plants, as well as the introduction of their phased production through industrial cooperation;
development and implementation of specific measures to introduce international construction standards and advanced foreign technologies at each stage of the implementation of projects for the construction of new and the modernization of existing hydroelectric power plants;
hearing reports at least twice a year on the work carried out by the responsible ministries and departments to ensure the timely and complete implementation of the Program, including the activities carried out by the Council of Ministers of the Republic of Karakalpakstan, regional and Tashkent city khokimiyats to attract private entrepreneurs to the construction of hydroelectric power plants and to assist them;

taking strict control over the timely and complete implementation of the measures defined by the Program, as well as coordinating the activities of ministries and departments to resolve emerging problems.

Grant the Republican Commission the right to make changes and additions to the Program, if necessary, while maintaining its general parameters and indicators.

4. In order to accelerate the construction and commissioning of micro and small hydroelectric power plants with the participation of the private sector in mahallas:
a) within a week, create working groups under the leadership of the Chairman of the Council of Ministers of the Republic of Karakalpakstan, khokims of the regions and the city of Tashkent (hereinafter referred to as the working groups);
b) working groups:
within a week, form a list of project areas on which it is possible to build micro and small hydroelectric power plants;
implement measures for the broad involvement of domestic entrepreneurs in the construction of micro and small hydroelectric power plants;
together with JSC "Organization of Electronic Online Auctions" in order to determine the initiators of projects for the construction of micro and small hydroelectric power plants through auction trading, ensure the placement of projects at auction trading in accordance with the Decree of the President of the Republic of Uzbekistan dated September 9, 2022 No. UP-220;
submit reports to the Republican Commission on the results of the work performed at the end of each quarter.
5. Establish that:
a) within the framework of promising investment projects provided for by the Program, in agreement with the Republican Commission, it is permitted to:
develop design documentation based on proposals from foreign design and consulting organizations based on international construction standards, obtain opinions from expert bodies and apply them in construction;
for projects implemented jointly with foreign investors, identify foreign investors (private partners) by selecting the best proposals and conclude contracts with them;

conclude contracts with consultants who have experience in projects implemented jointly with foreign investors, according to the results of the selection of the best proposals;

b) within the framework of investment projects implemented by the Company and provided for by the Program:
the provisions of paragraph 13 of the Resolution of the President of the Republic of Uzbekistan dated March 30, 2022 No. PP-104 "On measures for further reform of the hydropower sector" shall apply;
for expenses on all types of compensation payments, replanting valuable species of trees and shrubs (planting trees and shrubs, caring for them), as well as for all other expenses determined by legislative acts, if these expenses are not provided for by the approved pre-project and design documentation, it is not necessary to make changes to the pre-project and design documentation that provide for taking into account these expenses.
In this case, the above expenses are covered and subsequently taken into account when calculating the cost of the facilities.
6. The Ministry of Energy, together with the Ministry of Economy and Finance, as well as the Company, within two months:

study the experience of building micro- and small hydroelectric power plants in foreign countries, in particular Turkey and China, and also make a proposal to attract private investors to this area and encourage them;

submit for approval to the Cabinet of Ministers the Target indicators for increasing operational efficiency, reducing the cost of production and reducing the Company's expenses for 2025-2030. 7. To the Interdepartmental Tariff Commission under the Cabinet of Ministers (D. Kuchkarov):

to review the tariffs for the sale of electricity generated at hydroelectric power plants within the Company to ensure the implementation of investment projects envisaged by the Program until 2028;

to ensure the liquidation of accounts receivable for sold electricity, and subsequently - that the amount of accounts receivable does not exceed the amount of electricity sold over the last two months.

8. To the Ministry of Economy and Finance, the Ministry of Investments, Industry and Trade, as well as the Ministry of Energy to ensure the inclusion in the List of investment projects implemented through government borrowing for 2024 and the provision, in the established manner, of a state guarantee on behalf of the Republic of Uzbekistan for investment projects specified in Appendix No. 1a* to this resolution.

9. To amend and supplement certain resolutions of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan in accordance with Appendix No. 4.

10. To assign to the Minister of Energy Zh.T. Mirzamakhmudov personal responsibility for the effective organization of the implementation of this resolution.

The implementation of coordination and control over the activities of the ministries and departments responsible for the implementation of this resolution shall be assigned to the Prime Minister of the Republic of Uzbekistan A.N. Aripov.
